Switchmen Technology Management prioritizes your data security and privacy while delivering managed IT services tailored to your business needs.

This Privacy Policy (the "Policy") describes how Switchmen Technology Management ("Switchmen," "we," "us," or "our") processes information and data, particularly in the context of providing Managed IT Services (the "Services") to our business clients ("Clients").


Our Role in Data Processing

For the purpose of providing the Services, Switchmen typically acts as a Data Processor or Service Provider on behalf of our Clients. Our Clients remain the Data Controller (or Data Owner) of the data we access. This means:

Client Data: We process your corporate and user data (which may include Personal Data) solely based on your instructions as defined in the Managed Services Agreement and for the purpose of providing the Services.

Our Business Data: We act as a Data Controller for the Personal Data we collect directly from our Client contacts, employees, and website visitors for billing, communication, and marketing purposes.


Information We Collect and Process

1. Information Collected for Service Provision (Client Data)

In the course of providing IT Services such as monitoring, maintenance, and support, we may access, process, or store the following types of data on your behalf:

Technical Data: Log files, system usage data, IP addresses, device identifiers, configuration settings, and performance metrics from Client-controlled IT systems.

User Account Data: Usernames, email addresses, and encrypted passwords/hashes necessary for administrative access and support.

Content/Files (Incidental Access): Any documents, emails, or other files stored on Client-managed systems. Our access is strictly incidental to providing technical support and maintenance.

Support/Communication Data: Details of support requests, service tickets, and communications between Client personnel and the Switchmen team.


2 Information Collected for Our Business Operations (Switchmen Business Data)

We collect this data directly from our contacts for our administrative, billing, and contractual purposes:

Contact Information: Names, job titles, business email addresses, and business phone numbers of Client contacts.

Financial Data: Billing addresses and payment information (processed via secure, third-party payment platforms).

Website/Marketing Data: Information you provide when contacting us via our website, subscribing to newsletters, or aggregated, anonymous website usage data.


How and Why We Use Your Information

Data Sharing and Disclosure

Switchmen will not sell, rent, or trade Client Data or Switchmen Business Data to third parties. We may share data in the following limited circumstances:

Subprocessors and Vendors: We use trusted third-party software and service providers (e.g., remote monitoring and management (RMM) platforms, professional services automation (PSA) tools, cloud infrastructure providers) to deliver the Services. These third parties are contractually bound to protect the data and are prohibited from using it for any purpose other than providing services to us.

Legal Compliance: We may disclose data if required by law, subpoena, or other legal process, or if we believe in good faith that such action is necessary to comply with legal obligations, protect our rights or property, or ensure the safety of our Clients or the public.

Business Transfers: In connection with a merger, acquisition, or sale of all or a portion of our assets, provided the acquiring entity agrees to adhere to this Policy.


Data Security and Retention

Security Measures: We implement and maintain commercially reasonable technical, physical, and administrative safeguards, including data encryption, access controls, and security awareness training for employees, to protect data from unauthorized access, disclosure, or destruction.

Client Data Retention: We retain Client Data only for the period necessary to fulfill the Services under the MSA and as directed by the Client. Upon termination of the MSA, Client Data will be returned or securely destroyed in accordance with the agreed-upon Exit Plan.

Switchmen Business Data Retention: We retain contact and billing information for as long as necessary to maintain the business relationship, comply with our legal obligations, and resolve disputes.


Your Rights Over Your Personal Data

For Personal Data where Switchmen is the Data Controller (e.g., your business contact information), you have certain rights, including:

Access and Correction: The right to request access to your Personal Data and to have inaccurate information corrected.

Opt-Out: The right to opt-out of marketing communications at any time.

For Client Data, all user rights requests (e.g., deletion, restriction of processing) must be directed to your organization (the Data Controller), which will then instruct us.


Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will post the updated policy on our website and update the "Last Modified" date. If the changes are material, we will provide more prominent notice.


OPTING OUT OF COMMUNICATIONS

You may opt-out of marketing communications at any time.

For Client Data, all user rights requests (e.g., deletion, restriction of processing) must be directed to your organization (the Data Controller), which will then instruct us.

By "Opting In" to or using a “Text Message Service” (as defined below) SWITCHMEN TECHNOLOGY MANAGEMENT LTD, you accept these Terms & Conditions.

This agreement is between you and SWITCHMEN TECHNOLOGY MANAGEMENT LTD or one of its affiliates. All references to "SWITCHMEN TECHNOLOGY MANAGEMENT LTD, "we," "our," or "us" refer to SWITCHMEN TECHNOLOGY MANAGEMENT LTD, 1301 – 110 SWITCHMEN ST., VAN, BC

DEFINITIONS
"Opting In," "Opt In," and "Opt-In" refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.
"Text Message Service" includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).
CONSENTING TO TEXT MESSAGING
By consenting to receive text messages from us, you agreed to these Text Messaging Terms and Conditions, as well as our

E-SIGN DISCLOSURE
By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.

SWITCHMEN TECHNOLOGY MANAGEMENT LTD TEXT MESSAGE SERVICE PRIVACY POLICY

We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but isn't limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Nonetheless, we reserve the right always to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn't intended to modify our general Privacy Policy, incorporated by reference above, which may govern the relationship between you and us in other contexts.


COSTS OF TEXT MESSAGES

We do not charge you for the messages you send and receive via this text message service. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as by sending a HELP request).

FREQUENCY OF TEXT MESSSAGES

OPTING OUT OF TEXT MESSAGES

If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message.
